Privacy Policy

1. Scope

This Privacy Policy explains how ProjChecks LLC ("ProjChecks," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information through projchecks.com, related forms, communications, transactions, and online services.

This policy does not replace a separate privacy notice or data-processing agreement that may apply to a specific client engagement, employee relationship, or third-party platform.

2. Information We Collect

Depending on how you interact with us, we may collect the following categories of information:

•        Contact and identity information: name, company, job title, mailing address, email address, phone number, and account identifiers.

•        Project and inquiry information: project location, role, service interests, urgency, uploaded files, messages, meeting information, and other details you choose to provide.

•        Transaction information: products or services purchased, order status, billing and shipping details, payment status, refunds, and customer-support history. Payment card data is generally handled by the payment processor rather than stored directly by ProjChecks.

•        Device and usage information: IP address, browser type, device identifiers, referring pages, pages viewed, approximate location derived from IP address, and interaction data collected through cookies or similar technologies.

•        Marketing preferences: newsletter subscription status, communication preferences, and engagement with marketing communications.

•        Derived information: basic inferences used to route inquiries, improve content, prevent fraud, or understand service demand.

3. Sources of Information

We collect information directly from you; automatically from your browser or device; from payment, hosting, scheduling, analytics, email, fulfillment, and security providers; and from referrals or publicly available business sources when appropriate.

4. How We Use Information

We may use personal information to:

•        Respond to inquiries and schedule discussions.

•        Evaluate, propose, perform, and administer professional services.

•        Process orders, provide downloads, ship products, and manage returns or refunds.

•        Operate, secure, troubleshoot, and improve the Site.

•        Authenticate users and protect against fraud, misuse, and unauthorized access.

•        Send transactional messages and, where permitted, marketing communications.

•        Maintain business, tax, legal, and project records.

•        Comply with law, enforce agreements, and protect rights and safety.

5. How We Disclose Information

We may disclose personal information to service providers and contractors that support hosting, content delivery, payment processing, accounting, scheduling, email, customer management, analytics, security, shipping, and professional services. We may also disclose information to professional advisors, government authorities, law enforcement, transaction counterparties in a merger or asset transfer, or others when required or permitted by law.

Service providers should receive only information reasonably necessary for their functions and should be subject to appropriate contractual or legal obligations.

6. Sale, Targeted Advertising, and Profiling

Current launch assumption: ProjChecks does not sell personal data for monetary or other valuable consideration and does not process personal data for targeted advertising or profiling that produces legal or similarly significant effects. The developer must confirm this statement against all production analytics, advertising pixels, embedded tools, and third-party integrations before publication.

If these practices change, ProjChecks will update this policy and implement legally required notices, opt-out methods, and recognized universal opt-out mechanisms before the change is activated.

7. Cookies and Similar Technologies

The Site may use essential cookies required for security, forms, checkout, and core functionality. It may also use preference or analytics technologies only as described in the Cookie Policy and production cookie inventory. Nonessential technologies should not be represented in the policy or banner unless they are actually configured.

You can manage cookies through available consent controls and browser settings. Blocking some cookies may affect Site functionality.

8. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this policy, including to provide services, complete transactions, maintain tax and business records, resolve disputes, protect security, and comply with legal obligations. Retention periods vary based on the type of information, the relationship, contractual requirements, and applicable law.

9. Data Security

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information and the size and operations of the business. No online system is completely secure, and we cannot guarantee absolute security.

The developer must ensure that production forms, accounts, integrations, file storage, and checkout tools use secure connections, least-privilege access, strong authentication where available, and user-owned administrator accounts.

10. Your Privacy Choices and Rights

You may unsubscribe from marketing email by using the unsubscribe link in the message or contacting us. Transactional or service-related messages may continue when necessary.

Depending on your state and whether the applicable law covers ProjChecks, you may have rights to request access, correction, deletion, portability, or information about certain disclosures, and to opt out of certain sales, targeted advertising, or profiling. We may need to verify your identity and may retain information needed to document and complete the request.

To submit a privacy request or appeal a decision, email hello@projchecks.com with the subject line "Privacy Request." Describe the request and the state in which you reside. We will respond as required by applicable law.

11. Children

The Site is intended for business and adult users and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has submitted information, contact us so we can review and delete it as appropriate.

12. Third-Party Sites and Services

Links, social media platforms, embedded tools, payment services, and other third-party services have their own privacy practices. Review their policies before providing information directly to them.

13. U.S. Operations

ProjChecks is based in Colorado, United States. Information may be processed and stored in the United States and other locations where service providers operate, subject to applicable contractual and legal safeguards.

14. Changes to This Policy
